HI seniors
I am a fresher and have been recruited by an MNC 3 and half month back having no bond and i only received a offer letter from the company in which the salary structure and next grade is mentioned and nothing is mentioned about the notice period. i am not in receipt of appointment letter in which 3 month notice before leaving the job condition is mentioned.
My HR ask me that u have to serve 3 month notice before leaving the job otherwise legal action will be done against you. So please suggest me regarding the above problem as soon as possible

If you accepted to serve for 3 months notice period you have to work for the notice period . Other wise they have the right to take up a legal action against you with the help of the letter which you gave to them .
Or else try to convince your HR. They may help you to solve this issue .

In my opinion the company can't take legal action against you if you do not serve the notice period. Logically because they have not given you your appointment letter which contains the terms & conditions of employment.
At the time of joining they only provided you with an offer letter which does not talk about the notice period. Following the offer letter If they had given you an appointment letter which you would have accepted then the company had full right to file a legal case against you.
I would suggest you to amicably handle this with your HR.

You say that you haven't got any Appointment Letter.
But did you blindly sign any documents while joining? Pl think cooly & recollect--if they are saying so confidently, then they COULD be having some document.
Second point: You are fresher. Usually any company [even MNC] has 6-12 months as Probation AND the Notice period during probation is usually 1 month while after probation [i.e. regularised service] it would be higher. So your HR may be using this point to browbeat you into submission, by saying the notice period as 3 months. Pl checkout the HR Policies reg this aspect--you should be able to find them from your seniors there.
Third Point: Since you have put in only 3-4 months of service, the worst-case scenario could be forgetting this experience if you vanish & join a new job. But this is the last resort--IF YOUR facts are right.

I face a similar problem , I have worked for a company for over two months. Now I have a better offer so I have left the previous company without any notice. I am a fresher and there was not any bond associated with the previous job. I was also in the probationary period. I just possess the ID card . I have worked for 20 days and if they wish they can retain the wage they would have to give me. If i send the id card through courier will tat be ok? Wat else would I have to face?

hello, if they have not given you the appointment letter or anything in which it is mentioned that you have to serve a notice period then they cannot take any legal action. But, please recollect if at all you have signed or acknowledged any paper or testimonial wherein it is mentioned that you have to serve the notice period. Does your offer letter speak anything about the notice period? please go through the offer letter they have given to you.
