PF Deduction New Rule - Case Law - High Court

Dear All, I want to know that these days a big issue regarding PF is there.Earlier PF should be deducted on basic salary and that should be accroding to minimum wages act,but now for bonus,performance incetives also we have to deduct PF.This is a notification from Gujrat high court and it is taken by Haryana government as well.I belongs to Haryana and now it is applicable to our company also.I dont have full information.I need this full information or if i have writen something wrong then make me correct. dear meenu i donot think PF should be deducted on statutory bonus or performance incentive. PF act does not say so.if have any notification or court order,pls let us also know. in my view it should not be deducted on these heads. regards j s malik

Dear Meenu, Mallik Sir is correct and so far oraganizations deducting pf on Basic + DA or FDA or VDA , Special and Personal Pay only . Incase you have any notice / gazzette is available with pl.do put it in mail. Regards, Sekhar

p.f will only be deducted from basic + da only. that is sure. but whether p.f. can be deducted from encashed earned leave. our company has done it last year

dear arun as per notification issued employee provident fund organisation dated 5 th may 2008, there will not be subscription of PF on leave encashment whether it is paid in between of service or paid during full and final settlement. regards j s malik

We are decuting PF contribution from employees wages from Basic, DA , VDA. Wheather conveyance allowance is also to be included for PF deduction.

dear kalijanni no need to refer case law ,it is clearly mentioned in act it self. you can read section 29 of employees provident fund scheme1952. regards j s malik

Mr Mallik is right. PF act says no pf amount will be deducted on leave, bonus,performance incetives.
