Hi, Can some one tell me how many minimum casual/earned & sick leaves needed to be given in software companies in India? My company says only 12 casual/earned and 10 sick leaves total 22 in all.

Hi,

The usual structure for all companies is 12 days CL, 12 days PL, and 12 days SL. The SL is applicable for non-coverage of ESI employees. Overall, it is left up to management discretion in fixing the leave policy.

Firstly, one must understand that the IT industry falls under the Shops and Establishment Act. In such a case, the leaves specified under the act have to be extended; otherwise, it will be treated as non-compliance. If the company provides more leaves over and above those specified under the act, it is acceptable. The details pertaining to calculation and credit are mentioned in the rules. Please refer to the Shops and Establishment Act of your state if your company is in India.

Dear All,

Hi, we are providing 20 days of Paid Leave (PL), which equates to 1.6 days per month, and only 8 days of Sick Leave. During the Paid Leave, Saturdays, Sundays, and other closed holidays are exempted.

In my company we have PL : 15 and CL : 10. No sick leaves PL : For Vacation CL : For Emergency and Sick. Apart from this we have 10 paid holidays. Thank you

As stated by Mr. Patrudu, you should refer to the Shops and Establishments Act applicable to your state. Provisions therein should be complied with. Encashment, carrying forward, and such policies should be decided within the framework of this Act.
