Dear All, As per M.P. Industrial Employment Standing orders an employee has to be get retire at the age of 60. But is there any provision that we can hire beyond 60, because in many companys we have seen that employees are working even after 60 years of age. Please help

Sometimes the Standing Orders in some companies also provide for management's discretion to extend the retirement age beyond 60 years for say another three years subject to medical fitness.In such cases the age of retirement can be extended.Otherwise, the company can hire them as consultants who are not considered as employees and are not subject to normal service conditions of employees.

Dear Avinash, you have not mentioned about Retirement age in your Company which is very vital for replying.Further, what is the age of the Employee whom you are proposing to hire.What is the rationale of Hiring an Employee who has crossed 60 Years
By Hiring an Employee who has crossed 60 years you are creating a precedent for your organization, Consequently, your Retirement age also should go up accordingly
Extension of service consequent to Retirement is different from Hiring an Employee who has attained 60 Years

Please check age of superannuation mentioned in the MP Act/ rules. You can’t employ a person whose age is equal to or above the said age.

Dear Dubey,
The MP standing orders or any other state SOs lay down age of retirement. At the same time, to my knowledge, it does not bar recruiting retired employee as Consultant or such other capacity provided you need his services and he is physically fit.

Retirement age in our company is 60 yrs in line to Standing Orders in M.P.

However we have sorted the issue i have spoken to Labour Dept and they are saying u can extend retirement age by an MoU between employee and employer and the same proviso is given in SO rules also

When there is a provision in your standing orders for extending the retirement age by the management by mutual discussion, then why this question? and why this was not brought to the notice of members in your post?
