Hello,

This is regarding the full and final settlement of the employee. The performance bonus was one of the components of my CTC. I've left the organization before the completion of a year. Generally, performance bonuses are paid on a pro-rata basis, but my employer is refusing to do so.

Can anyone guide me on this? Is there any law for it?

First you letter of appointment is to be considered. Thereafter, accordingly you can demand your dues.

Performance bonus is always at the discretion of management. It does not matter whether it was in your CTC. CTC is meant mostly to make a fool of you and to show more than what you are guaranteed and mostly less than what you get in hand.

If you have left the company, the management is under no obligation to give you the bonus. Why should they? Bonus is meant to incentivize you. You left, why should they incentivize you?

It states that a performance bonus will be paid after evaluation by management at the end of the year.

I joined on June 25, 2015, and left the organization on June 15, 2016. The previous company paid the performance bonus on a pro-rata basis.
