Dear seniors, please answer my query. I have resigned from my previous company, and I want to claim my bonus amount. However, they are saying that I have to go there and sign Form C and Form D to receive the bonus check. Is it necessary for a resigned employee to sign these forms? Would it not be acceptable for me to provide a separate letter acknowledging receipt of the bonus amount? Can you suggest any alternative ways for me to obtain the bonus check? It is not feasible for me to go and sign Form C and Form D.

For bonus, the employer has to seek forms that need to be filled in:
- A register showing the details of the amount of bonus due for each of the employees and their deductions under sections 17 and 18, and the amount actually disbursed, is Form C.
- Annual Return – Bonus paid to employees for the accounting year ending is Form D.
These forms are to be signed by the employer. Please check with your company again.

Hi, You can request them to send the cheque through Regitered Post with acknowledgment card which will be valid evidence for receipt of payment. Thanks & Regards, Guru

As per the company's rules, it is necessary to sign the documents related to your leaving. If you do not sign them, it implies that you are at risk of losing your bonus. I have faced this situation in my life because the company is bound by a certain set of rules and regulations that must be adhered to. Therefore, it would be beneficial for you to go there and sign the documents after carefully reading through them. This action will prevent you from encountering any problems in receiving your bonus and ensure that you can easily convert your bonus check into cash.

The employer is not denying paying the bonus. Signature on Form C is mandatory in nature. As such, the employer cannot be forced legally. However, it can be mentioned in the column of signature that "paid by a/c payee cheque and separate receipt obtained," which will serve the purpose, and practically, it is done subject to the employer's satisfaction. Sharmila ji has rightly advised you to request your employer and find a way out.
