Dear Ravi,

The following are the basic differences:

1) The Industrial Disputes Act is applicable to all industries. The BIR Act is applicable to specified industries like the textile industry, power transmission industry like the BEST in Mumbai, sugar industries, and the establishments in the cooperative sector such as cooperative banks, etc.

2) The Industrial Disputes Act does not provide for the recognition of trade unions. The BIR Act provides for a Representative Union and the Union in the approved list, which have the sole bargaining power.

3) The workmen have to issue a charter of demands to seek any change in the existing service conditions under the Industrial Disputes Act, whereas they have to issue an approach notice under the BIR Act.
