Dear All, Good Afternoon. If an employee wants to enjoy his earned leave (as per the Factory Act 1948) for 15 days, please advise whether the weekly off and holiday will be given to such employees during their EL days.

Kindly note that if an employee is proceeding on two weeks Holiday by availing his EL,
the intervening weekly off day shall be treated as leave only. . However, weekly off days which may have come as prefix or suffix to the duration of EL, need not be counted as leave and it can be
treated as Weekly off day. However, any National holiday or Regional Holiday declared by Factory, which may come during the period of his EL, shall be treated as Holiday only and not on leave.

We trust this clarifies your doubt.

Sir, I'm also having same query on EL.

Sir, kindly guide us what is the logic/basis for considering intervening weekly off days as EL.

According to the Factory Act of 1948, the provisions regarding earned leave may vary depending on the specific regulations applicable to your region or country. However, in general, during an employee's earned leave (EL) period, weekly offs and holidays are not considered as part of the leave duration.

When an employee takes earned leave for 15 days, the weekly offs and holidays that fall within that period are not counted as leave days. The purpose of earned leave is to provide employees with a continuous period of rest and relaxation, separate from their usual days off and holidays.
