Hi, We have a factory with around 80 workers including both shifts, and an attached engineering and administration office has a team of around 120 staff which includes engineers, managers admin staff. My question is should we declare worker count as 80 or 200 while applying for a factory license.

Dear Colleague,

As far as Provisions of the Factories Act 1948, section 2(l) “worker” means a person [employed, directly or by or through any agency (including a contractor) with or without the knowledge of the principal employer, whether for remuneration or not], in any manufacturing process, or in cleaning any part of the machinery or premises used for a manufacturing process, or in any other kind of work incidental to, or connected with, the manufacturing process, or the subject of the manufacturing process [but does not include any member of the armed forces of the Union];

If you read the definition it is a very wide one in nature as you understand that " ANY PERSON". This includes workers in normal understanding / staff/ supervisors/ managers and so on. Hence you need to show the total number in the application.
