Dear Seniors & Experts,
In Tamil Nadu, TANGEDCO declared Power Holiday in the State effective 1st March 2011 in view of acute power shortage.
My query is the power holiday scheduled ( monday to saturday) in various areas be clubbed & converted as "Weekly Off" so that Sunday be declared as working day to ensure Production does not suffer as the earnings for the Employer and through them to Employee depends on "production output, meeting the targets" etc.
Does the Employer has the right to change the weekly off to get clubbed with "power holiday"? If it can be done, who are all the Authorities to be kept informed of the same as per Labour Laws prevailing in Tamil Nadu?
Your expert opinion please.

Dear Sundar
This power cut is varing from monday to saturday depends upon the region.legally you can declare lay off for the day.
however you can change weekly off by informing deupty director of factories or factory inspector whosever is compentent but at the same movement i feel worker should get weekly off within 10 days.

Mr. malik has rightly said that weekly off can only be change by informing the competent authority of the region and what he said that worker should get week off within 10 days, i think week off should be provided after six days of continues working and compansatory off should be provided after 10days of continues working.

In my view, if it varying every week and power holiday fall withing 10 days than no need to inform any authority since it has been mentioned in Act clearly to observe weekly holiday at 11th day of working.

Dear Mr. Sundar,
The Employer has always right to make some decision. In case of your's
you did not mentioned either your unit has labour union or not, if your
manufacturing unit containes labour union then the managment should
give perior intimation of changing weekly off.
This is for your informaiton,
Thanks

Thanks for every one who spent their valuable time to reply to me. The Factory is situated in Kancheepuram District Tamil Nadu. However "not welcomed news from the Industries" (may be sad news) is TANGEDCO declared power holidays for two days - one from Monday to Saturday and another on SUNDAYS through the State. 6 am to 6 am (24 hrs).
Hence the question of changing the weekly to combine with power holiday is getting ruled out.
TANGEDCO said any one violating this rule will be penalised heavily!
All micro, small & medium scale industries are suffering lot of financial crisis due to this power holiday as well as 40% power cut on a daily basis plus power restriction between 6 pm to 10 pm.
Unless some drastic action is taken by the Central Govt to be accepted by the Govt of TN too, Koodangulam Nuclear Power Plant which is ready for commissioning, cannot be commissioned. If commissioned TN can over come the much wanted "power"(what I mean is the electricity).

Sundararaman
