Hi All, One of our Women employees is getting a 40000 salary. As employer side what is the Maternity benefit we have to pay her. Kindly advice. Best Regards, Ambika

The Maternity Benefit Act entitles eligible female employees to the following benefits:
Maternity Leave: The Act provides for a maximum of 26 weeks of maternity leave, which includes eight weeks of postnatal leave. The duration of leave may vary in certain circumstances, such as in case of multiple births or if the employee already has two or more surviving children.

Maternity Benefit:
During the period of maternity leave, the employee is entitled to receive maternity benefit, which is calculated at the rate of her average daily wage for the period of her actual absence.

Medical Bonus:
In case the employer does not provide free medical care to the woman, she is entitled to receive a medical bonus of Rs. 3,500.

To calculate the maternity benefit for your employee, you can use the following formula:
Maternity Benefit=Average Daily Wage×Number of Maternity Leave Days
The "Average Daily Wage" is calculated by dividing the sum of wages earned during the three months preceding the maternity leave by 90.It's crucial to note that the salary components considered for the calculation may vary.

Hi,

182 days salary needs to be paid to the employee. This is has nothing to do Rs.40,000/- salary. Also further extension for one month should also be considered subject to submission of valid proof from the treating Doctor. Where ever feasible after 182 days of MB leave if work from home is feasible the same can also be considered on humanitarian grounds.
