Dear Gowramma,

As for as Recovery of Wages is concerned:

It looks that all your request with management has turned down and as a last resort, you may have to do the following. You all should be prepared to have a strained relationship with management or else management will give you sweet talk and make you to go further drain.

First - All the faculty together, give representation to management regarding non payment of wages with copies to a) Labour Commissioner b) AICTE /Education Administration Authority c) Labour Minister both at Central and State d) Education Minister both at Central and State. If nothing is working, then you may have to move to Civil Court and Labour Court for recover of dues.

As for as Life is concerned:

The faculty members belongs to working class. Without wages, sustaining is difficulty. Each will have family, children may be studying. Life will be tough without wages. There are employer who don't care to pay in spite of pressure from authorities.

To sustain you need work which can gives wages is more important. It is for you and your other colleagues to look for alternative employment or else life will become more dangerous. It will give rise to family disputes where the bread earner will loose respect and peace. You can recall an employees wife in Kingfisher (King of good times) killed herself for similar reasons. Don't wait for things to go out of hand. Act immediately since I can understand the pain you all going through. I am sure, most of you are depressed and it is a difficult phase.

This is one of the options and you may choose advise of other members who have contributed here.

All the best.

Dear Friends,
Thank you very much for your concern and advices. These are the details of the college in question:
Jogaiah Institute of Technology & Sciences, College of Engineering and College of Pharmacy, Palakol was established in August 2007 under Chairmanship of Sri. Chegondi Harirama Jogaiah (Ex-Member of Parliament). The Institute is approved by the All India Council for Technical Education (AICTE), New Delhi and is affiliated to Jawaharlal Nehru Technological University (JNTU), Kakinada.
With regards.

Dear Mr. Nishant Pandey,

The staff is asking for salaries repeatedly since August, 2012. We have been told that the salaries will be cleared once fee reimbursement from the government is credited to the college account. We are sweet talked into wait until the reimbursement. Finally, a couple of months back the reimbursement is credited to the college account. But the amount is adjusted towards the loan repayment of a scheduled bank which gave loan to the management. Again, we approached the management for salaries. The management is now telling us that it is trying to raise a loan from private parties to clear off our dues. We came to know that the management is trying to sell the outfit some other party. We are not sure that the loan will materialize. We have no assurance of our pending salaries, if the management is successful in selling away the institution. The management has nothing to lose as the property values have gone up and it will be suitably compensated for whatever investment it had made on the college.

Regards.

Dear,

Whatever I understand that management is not vice with employees and playing big game and conspiracy with employee benefits. My advice to you that for a formal employee association rather fight individually with management and also keep note that there is no need to show-off by any one person, otherwise management would be take more agressive action against individual person. And start formal conversation with management regarding your salary issues and problem behind this and don;t forget to show-off your family problem by all these. Also keep maintaining record of all these communications and share with other employees for maintaining transperancy among you. Because this will be your first step against management and management will also try to break your group solidarity.

Further you can send your formal complain regarding management behaviour to the AICTE (or other approval authority, whatever), Local Government, Police Intimation (to secure you from any false complain by mgt.) State Govt. Education Dept / educaiton minister, Labour Commisioner and labour court. Also consult with any good labour lawyer (better any relative of your colleague who is lawyer or labour lawyer). Give at specific time period to college management to release your salary through proper medium and keep record of all the things.

Do all these things and share with us progress in this issue.

All the Best.

All India Private Colleges Employees Union (AIPCEU) is an initiative to form labour unions for private institution's teachers all over the nations. I am the founder of the forum. After various complaints & RTIs, we had gone to the supreme court for
(1) Digitalizing staff slaries, certificates non-confication, modern FSR verification to avoid fake staff parade in inspections and so on
(2) to stay and withdraw AICTE's new rule of 1:20
We are also in to other services such as getting back our rights of PF, Graduity, Maternity leave, Proper notice period during relieving the colleges, AICTE/UGC norms pay, forcing AICTE to give notification as per 7th pay commission.
Very soon we will organise peaceful protests
