Dear All,
We are registered for PF and ESI for permanent employees and we pay it regularly.We are in business of running multiplexes and we are having contractors in our establishment for various sites at JAIPUR,AJMER AND MEERUT and each of them are not having more than 20 manpower (Housekeeping and security) thus they do not pay ESI and PF to them.
1) As a principal employer do we require registration in labour office?
2) If the contractor does not pay PF, ESI as his has not employed more than 20 employees does our liability still arises to pay the same to contractual employees.
3) Please also guide as to apart from this what all registrations and legal compliances we require keeping in mind the business?
It would be of great help if seniors help in this context...

Dear Suruchi,
According to the Law all the responsibilities are come to the principal employear if thay have engaged the labour thru contract and the contractor does not having the PF & Esic no. May be your organisation is in multiplexes and any where in India. Registration is not complesary for contractor having less then the 20 emplyess in one location, if in one location you have two contractor and having less then 20 worker with each contract then registration is complesary.

This means that we need to get ourselves registered as principal employer with authority and also pay PF ESI on contractors behalf...

Dear Friend ,
The ESI &PF applicable to all employees inclusive of the contract labour employees ,if the contractor have no pf & esi registeration also the principal employer is responsible and should be paid in the main code no of the principal employer . The licence part comes each end evry state the principal employer certificate to be obtained with concerned labour departments if the contract emplyees more than 20 employees or state to state the strenth varies for example in Andhra pradesh the contact labour licence is requaired to take if the contract employees strenth more than 5 employees

while engaging contract labour, the principal employer becomes responsible for legal compliance. so u need to take care of these things
1. register ur company with labour office under contract labour
2. see to it that the contractor/s obtain license/renew
3. proof for payment of wages- the law says the payment has to be made to the contract labour in the presence of the principal employers representative. at least the payment proof to the contractors employees need to be collected from the contractors.
4. its good to ensure that minimum wages as per law are paid.
5. collect and keep in ur records the payment proof of PF and ESI, the payment needs to be done by the contractors, but u need to have the proof.
pl dont worry,help for registration and licensing related queries can be sought from the labour office, it just needs u to build a good rappo with them.

i question is that if we make done the job work by the vender or subvender or other contractor and the contractor and subcontractor and they are working other place as well as with us whether it makes the responsibility of the principal employer that he pay the esic or not against them. suppose A is principal employer and have the job from other many contractor but they have not their own esic no. then what is responsibilty of the principale employer against them. plz help me out it is necessary

Hi everyone we are facility management company, will anybody please tell me that which license is required for multiplex cleaning instead of shops & establishment there is some other license which we have to take care but i don't know about it please guide if anyone knows

Hi,
Actually wanted to clarify that the principal client is requiring pf and esi challans against the work done on contract turnkey basis.
1. As all employees(20 in all) in our company are drawing more than 16500 / month salary it should be not applicable?
2. Also the registration will be required or just return copy will fulfill the clients requirement?
3. In ESIC case is it necessory that if registered in some other state and working in another state & location say, registered in lucknow and contract is in patna need to inform the department about the location change. What will be the procedure then?

Dear All,
In this present query my reply is as follows
As per PF any employer engages 20 or more employees with directly or indirectly i.e through contractor those establishment should cover with PF Act.
The payment of contributions to the PF dept by the principal employer or contractor is only between internal matter of the employer and contractor. but any one has to pay to eligible employees contribution to PF dept. i.e below Rs 6500/- Basic+DA salaried employees only to cover with PF, rest of them choice of the management.
