I have a query.
Company A has given a contract (released Purchase Order) to various contractors for providing services like Sanitation, Gardening, Security Services, and Vehicle Transportation. The Purchase Orders released to the contractors do not mention the supply of manpower - what is mentioned is the provision of sanitation services, etc. The Purchase Order is released for a full year and renewed every year. The Contractor involved needs more than 20 persons to do the work. Will the Contract Labour (Regulation & Abolition) Act be applicable to Company A?

Are the workers engaged by the contractor hired for your specific factory/site? If not, does it not apply? You may use the above clause only if it's a big-time contractor and employees posted at your site are a small portion of the total strength. For example, G4 Securitas is not a contractor.

I wanted to ask whether applicability of Contract Labour is centralised or on state to state basis?
