I am working with an education institute in Bengaluru, where this college does not have any facilities except salary. Not even ESI and PF facilities for a 200-employee organization. When joining, they asked for my originals, which I submitted without receiving any acknowledgment. In July, I resigned, and they requested a 3-month notice period. Currently, there are still over 20 days of notice remaining, but I am unable to serve it due to health issues. Meanwhile, they are not releasing my documents and one month's salary.

Notice Period and Legal Actions

Was the notice period mentioned in your offer letter? If yes, then you are required to serve it or pay in lieu if that's the condition. If not, there is no need to serve as you have already served more than two months' notice. Request them to relieve you amicably. If they don't entertain your request, inform them that you will consider legal action in such a case.

Filing Complaints for Benefits

Please submit two applications: one to the PF Commissioner and the other to the ESIC Regional Director, regarding your company not providing benefits. Additionally, visit the labor office to address your issue.
