Dear Mr Jegadesh
TN Govt has not notified any Special Holiday for the Panchayat Election 2019. In the light of the Madras HC Judgement, no need to declare Holiday with wages for the Panchayat Election.

Pl show them the attachments and ask them to show how and what basis they are asking the declaration of Holiday for the Panchayat election 2019. Holiday declared under Negotiable Instrument Act is also not applicable as per the Supreme Court (attached). TN Govt should have declared Special Holiday under the TN IE (N & FH) Amendment Act as in Pongal (attached - not specifically mentioned as paid Holiday!).

Even @ the time of declaration of Spl Holiday for Pongal in 2018, TN Govt has not chosen to declare Holiday with wages. In the absence of clear Notification from the Govt, you need not declare paid Holiday for the TN Panchayat Election2019.

In his letter (Not GO), the Addl Chief Secretary has only requested for Holiday. JDISH again has requested for Holiday quoting the Panchayat Act. According to the Madras High Court in TN Petro Products case (attached), the leave and holidays for employees working in a private industry is governed by the provisions of the Tamil Nadu Industrial Establishments (National and Festival Holidays) Act, 1958 and therefore no need to declare Holiday with wages for Panchayat Election in TN for 2019. In case if any case is filed by any person, it is worth paying a fine of Rs 500/= as per sub-section 3 of Section 80 A of the Tamil Nadu Panchayat Act 1994 (pl check the provisions of the Act thoroughly as I am not able to find the same).
