Dear Sir,

Please let me have your advice on the following situation. I resigned from company X on the 16th of March. In the resignation letter, I clearly stated that I would serve a three-month notice period. However, the management approached me, offering to release me early without any notice pay.

Upon leaving the company on 31st March, the company now insists that I must pay three months' salary back to them. I still have about seventy-five thousand rupees (salary + LTA) pending with the company, but they are refusing to pay me that amount. Instead, they are asking for an additional fifteen thousand from me to fulfill the three months' notice pay salary.

How can I retrieve my money? I am eagerly awaiting your reply.

Nowadays, this is a common practice. The problem lies at your end as you don't have anything in writing when they commit you to leave before the notice period.

Go to your management, talk politely regarding their previous commitment. If they do not agree, inform them that you will complete your notice period before leaving. They will surely take notice.

In response to the resignation, neither have they given you an acceptance letter nor have they provided in writing that you will be relieved on a specific date. Please talk to them politely.

Dear Sir,

They have given me the acceptance of resignation letter in which they have clearly mentioned that my last date will be 31st of March. My new recruiter is happy with the resignation acceptance letter.

Dear Bhushan,

What I understood is that you have a notice period of three months, and you have submitted your resignation. Upon receiving your resignation, your management informed you that they would relieve you early if you desire an early release.

I am sure that you must have specified in your resignation that you would like to be relieved on a particular day (date). In this scenario, you need to decide whether you wish to be relieved early. Management cannot relieve you early and request notice pay. If they relieve you before the day mentioned in your resignation, your management is obligated to pay you notice pay salary.

Please check the relieving letter issued to you. Take note of the clauses mentioned in your letter.
