Please guide me on whether ESI is applicable for sales staff who will be appointed from our HO in Kolkata and then sent to other parts of the country where they will have to stay for an extended period. Is ESI applicable to these employees who will be earning a salary of less than 10,000 per month?
Also, please advise if ESI is applicable to these employees and how to manage ESI in this scenario. How can these employees claim benefits under ESIC if they are posted outside Kolkata but registered under the ESIC Act in Kolkata?

If the sales personnel are drawing a salary of not more than Rs. 10,000, then they are covered under the ESI scheme. If they are posted in branch offices situated outside the Regional Office of the respective State Insurance Corporation, then their name and details will be in the state where they are posted. Branches will have to send the returns, etc., to the Regional ESI Corporation's office with the details of the sales personnel working under them.
