My cousin had previously been employed at HCL. Due to health complications, her doctor recommended complete bed rest. Consequently, she informed her HR that she would not be able to continue with her duties. In return, the HR requested her to serve the notice period. Given her medical condition, she asked for permission to work from home, but her request was denied by HR. A few days later, she was penalized for not serving the notice period. At the time, she was unable to pay the penalty and sent numerous emails requesting a review of her situation, but received no reply. Eventually, she received a legal notice from HCL, to which she responded with a legal acknowledgment notice. Currently, she has an offer from another MNC, but they require a relieving letter from HCL. She is now willing to pay the penalty amount.

Questions Regarding Relieving Letter and Settlement Process

Will HCL provide her the necessary documents (particularly the relieving letter) after she makes the payment?

What is the typical duration for the full and final settlement and the issuance of the relieving letter?

Is there a specific process she needs to follow to formally initiate this?

Any shared guidance or experiences would be greatly appreciated. Thank you!

We have attempted to contact the HR department multiple times, but unfortunately, we have not received a response so far. Could there be a faster or alternative process we can adopt to resolve this matter? Additionally, my cousin's PF account seems to be locked. Could you please provide guidance on how to unlock it as part of the exit formalities?

  • Once the penalty is paid, HCL should provide the required documents, including the relieving letter. The full and final settlement process, along with the issuance of the relieving letter, usually takes around 15 to 30 days, but this timeline can vary. To initiate the formal process, your cousin should reach out to the HR department of HCL, specifically the individual handling her case. She should request a meeting to discuss the settlement and the issuance of the relieving letter. It's crucial to maintain a professional and polite demeanor throughout the communication to expedite the process. Additionally, documenting all interactions and agreements can be beneficial for future reference.
