Can anybody tell me the actual advantage of having DA as a part of the salary structure? Is it a statutory requirement? Can there be an alternative to it like 'Other Allowance'?
We have DA as a part of our salary structure. I am of the opinion that it is not required to have DA, and we could convert it to other allowances. Please correct me if I am wrong.

Hi,
BASIC + DA are computed for statutory requirements. There are lots of knowledge companies that are not providing DA in their pay structure. You can do away with that. This is my experience, and I do require professional advice if I am not correct.

Hi Soumya,
DA is a part of statutory requirements along with the Basic component (Minimum Wages Act). However, if you do not wish to show DA in your salary statement, please make sure that the total gross is more as compared to only Basic + DA.

DA is not statutory. It was introduced to neutralize inflation and protect the rest of the compensation structure. Subsequently, it became a part of union negotiations. The Minimum Wages Act only includes it in defining wages. It is not mandatory to have DA as part of wages. You will find that all the new industries do not have the DA component except in the public sector.

It depends if the amount in lieu of DA is added to non taxable component then it will not attract tax otherwise it will Arif

Agreed. It is not compulsory to include Dearness Allowance as a part of the salary structure, as Minimum Wages take care of inflation and DA aspects. However, if an Indian commercial organization chooses to incorporate DA into their salary structure, is it mandatory to revise it periodically? What are the rules and legal criteria concerning the fixation and calculation of DA? If DA is itemized in the payslip, is it obligatory for the DA percentage to be uniform for all employees? Do employees have the right to determine the DA amount based on their preferences and comfort?

We can very well include the DA in the Basic salary and have a head in the salary slip as "Basic + DA". By doing this, you can achieve two objectives at once. In this case, whenever the DA increases or decreases, you do not have to make any adjustments unless it falls below the minimum wages. If the DA increases by Rs. 250, then you have to increase the gross salary by Rs. 250 if it does not meet the minimum wage requirements. DA is fixed by either the State Government or the Central Government only.
As mentioned above, you can display Basic + DA combined. If an employee has a question, you can provide the current Dearness Allowance figure, deduct it from the current Gross + DA, and inform the employee of their DA amount (which is equal to the current DA).
