Benefits Available Under Various Acts in Case of Employee's Death

Please suggest benefits available under various acts in the unfortunate event of an employee's death. Here, I am presenting my query regarding the circumstances of her death.

One of my friends, a female employee, was on her way home after finishing work for the day, riding her Scooty. Unfortunately, a truck collided with her Scooty, resulting in her immediate passing.

I kindly request your assistance at your earliest convenience so that I may provide support to her family members or nominated beneficiaries in claiming compensation or benefits.

2. Her designation and nature of work.
3. Timing of office.
4. Time she left work on the day of the accident.
5. Time of the accident.
6. Was she a member of EPF? If so, for how long?
7. Total service in the present company.

Heelo Dinesh, Greetings of the day! With the assumption she is covered under EPF and ESI. Her dependent can claim from EPF under EDLI scheme and Funeral expenses from ESI. Regards, Shaikh Abedeen

In addition to the above benefits, the victim's legal heirs (parents, spouse, children, or siblings—if she was unmarried) can claim the following:

File a Claim in the MACT Court

File a claim in the MACT (Motor Accident Claims Tribunal) court, in the place where she was residing, either under section 163A or section 166 of the Motor Vehicle Act, quoting the truck number and, if possible, the name of the truck driver.

Check Insurance Policy for Personal Accident Coverage

Please check if the insurance policy against the vehicle also included a section for Personal Accident. In that case, the legal heirs may file a claim with the concerned insurance company, giving details and relevant documents.

Life Insurance Policy Benefits

Any Life Insurance policy invested in by the victim would also pay the sum assured and any other added benefits.

Additional Insurance Policies

If the victim or the office where she was working had a Personal Accident policy, life insurance, or Group Life Insurance policy, these would also pay the necessary benefits.

Mediclaim Policy Reimbursement

If the victim was admitted to the hospital and had a mediclaim policy, the expenses and ambulance charges, if incurred, can be reimbursed under the policy if all the necessary documents are submitted to the concerned insurance company.

All these benefits can be claimed simultaneously from the respective companies/organizations.
