In my office, they are deducting a professional tax every month, but they are not filing it. My doubt is, if we collect professional tax, whether we need to pay it to the government or if it belongs to the employer. If we need to pay it to the government, what is the procedure?
Kindly advise me on the same.

Professional Tax Deduction and Filing
Professional Tax can be deducted and deposited either monthly, half-yearly, or annually. For convenience, we deduct it monthly. For filing, we have to deposit the same with the Sales Tax department along with the employees' list mentioning individual deductions.

Dear Bharathi, Here is the attached challan format for PT for Maharashtra State. you can pay the tax in SBI on or before 20th of every month for last months PT. Regards nitin

Professional Tax has to be deducted from employees every month and has to be remitted to the PT account. It shall be paid by cheque, cash, or DD in your local PT office. First of all, tell me in which city you are working.
First, check whether your company is enrolled with PT registration. If so, take the registration number. Fill out the form (it varies between each state) and remit it to the local Professional Tax office.

We are also a new company in Chennai. First, in March 2011, we submitted the documents along with fees for P.Tax of employees for the first half and second half of 2010. Still, we have not received the registration number. These corporation employees are lazy like dogs and don't do their work. You should go to the corporation office, PTax section in your ward/division, and inquire about the details. You are required to pay tax for the entire period since the establishment of your company.
We also consulted a consultant who informed us that the charges for obtaining PTax registration are 3000/-, which is too high. If you can afford the consultant, simply pay him a service charge of 3000/- rupees, and he will handle everything. Therefore, we directly approached the Corporation of Chennai. It has been two months, and we still have not received the PTax registration certificate. The PTax department instructs us to pay PTax on one side, while on the other side, they are uncooperative and unhelpful. I am planning to visit the revenue officer in Ripon Building to inquire about our PTax registration.
Regarding the submission of PTax half-yearly, I had previously asked a question, but no one responded. It appears that no senior on this site has the knowledge or time to guide us on PTax.

Professional Tax is a state subject. The tax collected goes into the State Treasury. Some State Governments do not levy professional tax. For example, Jharkhand Govt., Bihar Govt., Delhi Govt. Any complaint in this regard must be registered with state Govt. authorities as defined under the legislation passed by the State Govt.
Suppose an employee is working in a company registered in Bangalore but the employee is posted in Delhi, the employer cannot collect Professional tax from the employee. But if that employee is posted in Bengal, the employer has to collect PT at the rate applicable in West Bengal and deposit the same in the WB Treasury.
