Dear all,

I hope most of you are going to write the papers. But the question is, how will they be asked? It will be in objective type only. So, if we discuss by asking questions, I believe we can learn certain things in HR. Therefore, let's start posting questions, and the person who posts a question should provide the answer if nobody replies within 2 days. I hope it works out.

Let me start with a question:

As you are well aware, according to the law, an employee can receive gratuity if they complete 5 years of continuous service with an organization. For instance, if an employee joins a private company and resigns exactly after completing 5 years of service. The situation is that at the time of joining, the employee underwent a one-year training period. The job was confirmed after one year, and PF and other deductions were not made during the initial year. The question now is, can the employee be given gratuity?

Thank you for sharing the link; it's really useful information for all of us.

From those discussions, gratuity cannot be given under the following situation:
1) During Apprentice Training (Standing Orders of Apprentice Act)

However, if an employee who is not under Apprentice training, but PF & ESI not deducted like Temporary staff (working full time), can be given gratuity...?

Please advise.

Also, could you post some new HR questions on this forum discussion? It would be a learning opportunity for budding HR professionals like me.
