Hello all, is there any ruling in EPF for physically disabled individuals where an employer's contribution is borne by the government? In other words, the employer does not have to make their contribution as it is covered by the government.

I would appreciate an early and fruitful reply, please.

Dear Kartiken,

I shall reproduce the explanation of 4(2) of EPS Act, 1995 in this regard.

"Provided that the Central Government shall pay the contribution payable to the Employees' Pension Fund in respect of an employee who is a person with a disability under the Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995 (1 of 1996) and under the National Trust for the Welfare of Persons with Autism, Cerebral Palsy, Mental Retardation, and Multiple Disabilities Act, 1999 (44 of 1999) respectively, up to a maximum period of three years from the date of commencement of membership of the Fund."

"upto a max period of three yrs" does that mean after three years the part of contribution is to be borne by the employer irrespective of the nth company that particular person is in?

Dear Kartiken,

I have cited above the provision in EPS-95. From the act, it is understood that after 3 years the contribution has to be paid by the employer. When I took this issue to our RPFC Office, they were also unable to provide practical details because they weren't involved in the process. They receive the contribution either from the employer or from the Government of India.
