P Tax Deduction Rule

Hello,
How to deduct P Tax for the companies having branches in different states. Our office is headquartered at bhubaneswar and have branches in different states. What P tax slab need to be deducted from the employees? Should it be based on the state in which they are posted or as per the state from where the salary would get credited. Please reply.

Dear Sangeeta Ji,
The profession tax is leviable on the basis of posting of the concerned member of staff. The rates of concerned state government for profession tax would apply to the staff in that state only. Even if one is transferred in the middle of a financial year from one state to another, the profession tax in still to be deducted at the rates prevailent in the state of last posting (monthwise) and remitted to the concerned state government authoity. It has no connection with the headquarters of the employer firm. Likewise, public holidays and other local laws are also applicable to the employees state-wise and not on the basis of headquarters' situation in some particular state.

1) In Case of General Assesses:

Rs. 1,60,001 to Rs. 5,00,000 10 %
Rs. 5,00,001 to Rs. 8,00,000 20 %
Above Rs. 8,00,000 30 %
2) In Case of Women Assesses:
Income Bracket Rate
0 to Rs. 1,90,000 0 %
Rs. 1,90,001 to Rs. 5,00,000 10 %
Rs. 5,00,001 to Rs. 8,00,000 20 %
Above Rs. 8,00,000 30 %
3) In Case of Senior Citizens:
Income Bracket Rate
0 to Rs. 2,40,000 0 %
Rs. 2,40,001 to Rs. 5,00,000 10 %
Rs. 5,00,001 to Rs. 8,00,000 20 %
Above Rs. 8,00,000 30 %
* On final tax amount, a surcharge of 3 %
**No surcharge above 10 lacs.

Mr. Shyam Agarwal has given the right answer. PT is concerned with individual states and hence may vary. So you have to ask your office in the concerned state to deduct the tax and remit to the respective state government.
