I have some doubt under section 25C and 25M which is related to lay off. As given under S.25A, 25C is only applicable to establishments having 50 or more workmen, and under S.25C employer can lay off to that persons who has completed 1year of continuous service.. does that mean if employers wants without granting prior permission from app.govt (as mentioned in 25M) can lay off to that person who have completed one year of continuous service.. and can retrench without giving any notice those who haven't not completed 1yr of continuous service yet. Or under section 9A employer have to give a notice to those persons.. but again it is applicable only to conditions specified in Schedule 4, and there is no mention of Lay off or Retrenchment....

Another thing whether before lay off or Retrenchment grant from the app. govt. Is necessary.. i.e. while or before giving a notice to workmen is it necessary that permission shall be granted by the government.?
