We will be interested in leaning more on the stand of the supreme court on this. If that is also favouring, there remains one question,whether "motherhood on surrogacy" also to be included in the Leave Rules of organisations.

The above decision is under civil service rules.Kerala High Court had given a similar decision under Maternity Benefit Act.The objective of the MB Act is to give benefit to employed women who became pregnant and who delivers a child.A women who gets child through surrogacy ,ie some other women getting pregnant and delvers, need not be given benefit under MB Act as it is against the spirit and purpose of the Act.To this extend the Kerala HC's decision is wrong.
