Dear members,
An union has formed recently with President, Secretary, Jt. Secretary, Treasurer besides an outsider as Convener. Convener is only corresponding with management on the union's letter head. So far, union has not given any authorisation for his correspondence with management. Now the Convener has started to correspond for non-union matters with management and also publish the same in the press against the management without the knowledge and consent of union executive members (as enquired verbally). Usually Union's Secretary is authorised to correspond with management.
Members are requested to advise -
1. Whether any reply is required to given by the management for non-union matters?
2. Whether the Convener can be legally authorised by the union members to correspond with management?
3. What appropriate action can be taken in this matter?
4. Any other relevant information.

Dear Mr. Kadali Rao
1) At the outset, you please write to the PRESIDENT of the UNION narrating the whole story happened so far and marking a copy to the SECRETARY as he is only authorized to communicate on behalf of the union and holding all powers after PRESIDENT. Request PRESIDENT to reply positively within STIPULATED PERIOD OF TIME. You can also mark a copy of all your correspondence between MANAGEMENT and UNION to the LABOR COMMISSION and your company LAWYER to remain on safer side and ensuring TRANSPARENT DEALINGS.

2) Convener or any UNION MEMBER has NO RIGHT to talk/correspond about NON UNION MEMBERS. If your management is responding to his statements, i would love to say that, your management is entertaining him to create more issues in the nearest future.

Through your company lawyer, you can issue a NOTICE to the CONVENER to stop UNAUTHORIZED DISCUSSION/CONVERSATIONS(which is not of his concern) with the MANAGEMENT, failing which he may have to face further consequences in the COURT OF LAW.

You can also seek help from LABOUR COMMISSION as how to deal with UNION MEMBERS.

3) Find out, to what extent PRESIDENT, SECRETARY and other members of UNION are supporting CONVENER, which may be happening behind the screen. Please dont conclude anything without having sufficient EVIDENCE to prove CONVENER - GUILTY

4) A company has right to fight against the FALSE ALLEGATIONS published in LOCAL NEWS PAPERS or exposed to MEDIA PERSONNEL.

A) You have to understand why UNION is formed?
B) What is the motive behind its formation?
C) Is your MANAGEMENT doing justice with your employees by all means?
D) Who are the people(employees) trying to SPOIL THE WORK CULTURE and CREATE ISSUES AT WORK PLACE

I had handled issues pertaining to 3 UNIONS in my ex-organisation. You will find someone trying to demotivate employees, play dirty games and make them fight against their employer. Find out those members and build a file against them. This will help you to terminate him without any pain.

Locate for GOOD MEMBERS in UNION and have discussions once in a fortnight. Develop your rapo with UNION MEMBERS to understand their moves.
