Hello,

How to deduct PTax for companies with branches in different states? Our office is headquartered in Bhubaneswar and has branches in various states. Which PTax slab should be applied to employees? Should it be based on the state where they are working or on the state where their salary is credited? Please provide guidance.

Dear Sangeeta Ji,

The profession tax is leviable based on the posting of the concerned member of staff. The rates of the state government for profession tax would apply to the staff in that state only. Even if one is transferred in the middle of a financial year from one state to another, the profession tax is still to be deducted at the prevalent rates in the state of the last posting (month-wise) and remitted to the concerned state government authority. It has no connection with the headquarters of the employer firm. Likewise, public holidays and other local laws are also applicable to the employees state-wise and not based on the headquarters' location in a particular state.

Mr. Shyam Agarwal has given the right answer. PT is concerned with individual states and hence may vary. Therefore, you have to ask your office in the concerned state to deduct the tax and remit it to the respective state government.

Professional Tax Slabs in Andhra Pradesh

PT is applicable on Gross. Professional Tax Slabs in Andhra Pradesh:

- Up to ₹5,000: Nil
- From ₹5,001 to ₹6,000: ₹60
- From ₹6,001 to ₹10,000: ₹80
- From ₹10,001 to ₹15,000: ₹100
- From ₹15,001 to ₹20,000: ₹150
- From ₹20,001 and above: ₹200

Dear,

The answers you got are incorrect. Statewise, P.Tax will be deducted from employees. For example, if you have a branch in Sikkim, P.Tax will not be deducted for those employees working there. If you have a branch in Bhubaneshwar, then P.Tax will be deducted as per the Orissa Govt P.Tax rule. In WB, the P.Tax slab is up to 3000, and P.Tax is Nil.

What you have quoted is Income Tax on individuals. Another answer deals with Professional Tax imposed by state governments. That means the question was not clear by just mentioning "P" tax. Can we not be clear while asking a question?
