Hi Members!

Please answer a small query regarding the permitted working hours in Delhi. I want to know this because my company works from 9:30 am to 6:30 pm on all six days. I want to understand the permitted hours and know what to do if we exceed the time limit. What is the legal way to convince my management to give Saturdays off as compensation?

Please guide...

Hi Prachi,

How are you? As per your duty hours, they extend up to 9 hours. So, there must be a 1-hour break after 4 hours of working. It means the normal working hours in a day are 8 if there is a 6-day week.

As per the Factories Act:

1. There must not be more than 48 hours of work in a week, so you can calculate it and mark the persons whose working hours in a week extend beyond that.

2. There must be a break of at least half an hour after 4 hours of continuous work.

So, what you can do is calculate the exceeding hours of work for each individual and allot them compensatory leave instead of giving them off on Saturday. Employees would also be happy with that since they can use these leaves as per their wish. Also, it will not affect the work since most of them would use leave on different days of the month or would use it on special occasions.

The criteria for allowing compensatory leave can be such as:

1. No leave for up to 4 hours of excess work.
2. Half-day leave for 4 to 7 hours of excess work.
3. 1 leave for more than 8 hours of excess work.

These leaves can be accumulated up to a maximum of 10.
