Earlier, we had obtained an ESI code number from Delhi. All our staff are registered under the Delhi ESI office. We have recently opened a new location in Gurgaon, and 50% of the staff have been relocated from Delhi to Gurgaon.

Now that we are operational in Gurgaon, do we need to acquire a new code for this location? If we do obtain an ESI code in Gurgaon, will we be required to fill out new forms for every employee, or can the old forms (already submitted in Delhi) be transferred to the Gurgaon office?

Your guidance on this matter would be greatly appreciated.

You need not get declaration forms for all such employees in Gurgaon. You should write to the New Delhi ESI RO with details such as:

1. Information about your new Gurgaon office.
2. Confirmation that you are paying contributions from the New Delhi office for the Gurgaon branch.
3. Assurance that you will submit separate RCC (half-yearly return - Return of Contribution Cards) directly to the New Delhi office with a copy to the Gurgaon ESI office.

If possible, please visit both the Delhi ESI office and the Gurgaon ESI office in person to obtain concurrence. After that, you can send your returns and remit the contributions in a separate challan from Delhi itself.

For newly joined employees, you can collect and submit declaration forms to the Gurgaon ESI office.

Can ESI contributions be deposited for all units all over India from the corporate/head office? If yes, what is the procedure?

The Gurgaon office will allot an additional code for your Gurgaon office - the employees' insurance numbers will not change; they can use the same with a change in the local office and dispensary. If you transfer the Gurgaon employees further to Noida, for example, you can issue Form 105 for their medical benefits at the transferred place, whereas the contributions are to be paid in the place originally allotted.

As already mentioned, you can pay all the contributions in the place where the head/corporate office is situated but in separate challans. The return of contributions is to be submitted to the respective regional/local office from the corporate/head office, with a copy to the regional office where the head/corporate office is located.
