I would like to know how many working hours (excluding lunchtime) per day or per week are permissible under the Shops and Establishment Act for an establishment (service company) in Navi Mumbai.

The Shops and Commercial Establishments Act is a state Act, so there may not need to be a common provision in many respects. The working hours may vary from 8 to 9 hours, and the time including intervals (spread over) may also vary from 10 hours 30 minutes to 11 hours. For details, please refer to the Maharashtra Shops and Commercial Establishments Act.

Dear Prachi,

According to The Bombay Shops & Establishment Act, 1948, which was provided by one of our members on this site, section 14(1) deals with working hours, which may be read as follows:

14. Daily and weekly hours of work in shops and commercial establishment.
(1) Subject to the other provisions of this Act, no employee shall be required or allowed to work in any shop or commercial establishment for more than nine hours in any day and forty-eight hours in any week.

I would like to know how many working hours (excluding lunchtime) per day or per week are permissible under the Shops and Establishment Act for an establishment (Logistics company) in Mumbai, Delhi, Chennai, and Bangalore. Additionally, I would like to understand if forty-eight hours in any week include lunchtime.

Understanding Working Hours

The 48 hours of work per week or 8 hours per day is the actual working hours, excluding hours of rest. As already stated above, hours of work and spread over are different. Spread over is the maximum hours, including intervals for rest, which may be around 10 1/2 hours or 11 hours a day.
