Can a private organization offer a recruitment post with a VRS scheme?

A private organization can indeed opt for a recruitment post offering a VRS (Voluntary Retirement Scheme). However, the implementation of such a scheme must comply with relevant laws and regulations governing employment practices. It is essential for the organization to adhere to the legal framework concerning VRS eligibility criteria, benefits, and procedures. In case of any ambiguity or uncertainty regarding the legality of the VRS scheme, seeking legal counsel and guidance is advisable to ensure compliance with the applicable laws.

Hiring After Voluntary Retirement Scheme (VRS)

VRS being voluntary and not a mandated discharge, you can hire people after VRS. However, if it was a mass retrenchment, you cannot recruit new persons without considering those who were retrenched.

In the case of voluntary retirement, which is again excluded from retrenchment under the Industrial Disputes Act, the employer can proceed with hiring a new candidate without considering those who left the company of their own will.
