Facing Resignation Without Notice Due to Medical Reasons: Do I Owe Basic or Gross Salary?

vinay-kumar1
I'm working in X company, and my bond is going to complete on Mar 18, 2021. I have given my resignation on Feb 20, 2021, due to a medical reason (pregnancy) where the doctor has insisted on complete bed rest, and I could not serve the notice period for two months. My company is asking me to pay the salary for those months. Should I pay the salary? If so, should I pay the basic salary or the gross salary?

Why did she resign instead of availing the maternity leave?

Her notice pay needs to be calculated based on the basic salary, so she has to pay 12,432 x 2 = 24,864. It would be advisable to discuss with the management the possibility of waiving the notice period on humanitarian grounds.
