Is PF Enrollment Mandatory for Small Teams with International Workers? How to Handle Withdrawals and Salary Bifurcation

Hi,

Is it mandatory for the number of employees less than 20 to register in the PF of international worker? I would like to know about the procedure of PF enrollment in the case of an international worker and how he can withdraw. What should be the salary bifurcation?

Applicability

Every International Worker, other than an 'excluded employee,' should become a member of the Fund. There is no minimum period of stay in India required for the activation of Provident Fund compliance. Every eligible international worker must be registered from the first date of their employment in India.

PF Withdrawal Conditions for International Workmen

1. If the international worker is covered by an SSA (Social Security Agreement), the worker may withdraw the provident fund in accordance with the regulations of that particular SSA.

2. If the worker is not covered by an SSA, they can withdraw the provident fund at the age of 58, which is the retirement age. However, exceptions are made if they have retired due to any incapacity for work or are suffering from leprosy, cancer, or tuberculosis.

3. An international worker under an SSA may have the provident fund credited to their bank account outside of India. However, if not covered by an SSA, the PF will be credited to their bank account in India.

4. The Reserve Bank of India allows expatriates to keep their bank accounts in India even after repatriation in order to pay their outstanding contributions.
