Understanding Creche Requirements: Do All Factories with 30+ Employees Need One?

Dear seniors,

Please confirm that every factory should maintain a creche on the factory premises if the number of employees is 30 and above. Now, my questions are:

1. Does "employees" refer to both male and female employees or only to female employees?
2. Is there a rule stating that a creche does not need to be maintained if the company is unable to operate or is running at a loss?
3. What is the required distance that needs to be maintained from the factory to the creche?

Creche Facilities for Women Employees

A creche is for women employees. If the establishment doesn't have a creche facility, you can rent a creche center near your office premises. According to the Maternity Act and Factories Act, every office premises should have a creche if the number of women employees exceeds a certain threshold.

I am not sure about the distance from the creche facility. If the creche room is in the factory premises, you can place it anywhere in the premises, such as beside the lunchroom or near the dining area, etc., as long as it is feasible and close to where women employees work.

As per the Factories Act of 1948, a creche has become compulsory for every factory where more than thirty women workers are ordinarily employed. There shall be provided and maintained a suitable room or rooms for the use of children under the age of six years of such women.
