Overtime Pay for Salaries Over 35,000: Is It Really Required?

Dear Sir,

Is it compulsory or necessary to pay overtime payment for a person drawing a salary of more than 35,000 per month?

Please help us in this regard.

An employee's salary is not the criterion for paying overtime; neither can you deny based on that clause.

Could you please provide the designation of the employee you are referring to? What are his responsibilities?

Please understand, as rightly said by Mr. Venkata, salary is not a criterion for any employee to calculate overtime. It is applicable to all employees defined or specified as employees under the law. Secondly, if you have any long-term agreement with the union, then you may have the option to convert overtime to compensatory off, but it should be part of your agreement and standing order as well.

Payment of overtime wages is a statutory necessity under the Factories Act 1948, and the coverage under the Act extends to all who are directly or indirectly employed in the factory, including the premises (Section 2m). There is no salary criteria in the Factories Act.
