We have encountered a situation involving disciplinary action against a Workman who is on the permanent payroll. I would appreciate it if you could shed light and provide guidance on what disciplinary actions can be taken against an indisciplined Mathadi Worker under the Mathadi Act. Additionally, could you please outline the process for termination in the event that a Mathadi Worker is dismissed for indisciplined behavior and claims reinstatement?

Steps for Handling Disciplinary Actions

1. Issue a charge sheet and ask for an explanation.
2. Upon receipt of the explanation, if unsatisfied, start a domestic inquiry.
3. Conduct the inquiry with an outsider, an independent person, giving full opportunity to the charged employee to defend himself in view of the principle of natural justice.
4. Once the inquiry is completed, obtain the report and findings from the inquiry officer.
5. If the charge is proven, you can propose a punishment. Depending on the gravity of the misconduct, the punishment can be suggested. Just ensure that the punishment is proportional to the gravity of the misconduct.
