Factory Registration In Maharashtra

A factory with less tha 10 employees should be registered under which act Shop Act Maharashtra or factory act??.
If under Shop Act Maharashtra than what must be the category either shop or commercial establishment.??

Your query is confusing. Manufacturing unit less than 10 manpower is not factory, hence no factory license is required under Factories Act.By virtue of your business, you are not bound to have factory license. Min. threshold is 10 for license .

I also have a doubt about it
So for the above, if the Factory does not have a Licence to operate, is it legal?. the employees working with the facility will be governed and protected under which law.
In this connection isn't it right to take a licence showing 10 worker{ i.e. paying fees for 10 worker), rather than not having a valid Licence at all
Correct me if I am wrong
