Is the Bonus Act Still Applicable After Our Factory Move from Chennai to Gujarat?

Dear Seniors,

I am working with an engineering manufacturing company. The company was started in Chennai, and recently they have shifted the factory to Gujarat, and we are planning to shift the ROC to Gujarat.

My question is, in this scenario, will the Bonus Act be applicable to our company? Please suggest.

BONUS is a central act and is applicable throughout India.

I think that the doubt as to whether the change of location of the existing establishment would confer the benefits of a newly set-up establishment provided for in sec.16 of the Payment of Bonus Act, 1965 has prompted this question. The answer is 'NO'. For further clarification, please go through the explanation in section I of sec. 16 of the said Act.

Dear Mr. Sunil,

The bonus will be applicable if the headcount of employees is above 20 anywhere in India. It will be a minimum of 8.33% of earned wages, i.e. earned yearly (Basic + DA), regardless of whether the employee is based in Gujarat or Noida.
