Compensation Eligibility

Dear Sir,

I have worked for a Christian Ministry since 2010 July. My wife also joined one year later. I have recently put in a resignation request and so has my wife. I have been with them from beginning. The director has changed in between. I asked for 3 months pay in advance as compensation for both my wife and myself, but instead they made gave me a new set of policies which I had not seen before. I have agree or signed on this policy. And it was only brought to light when I asked for compensation.

Below is the new policy:

1 When a staff resigns, one month notice has to be given in advance by the staff. In absence of this notice period, one month pay can be paid instead of the notice period.

2. When a staff resigns and if relieved him /her immediately, then a three month separation pay is paid.

3. If a staff is terminated from service, then three months separation pay is given to the staff.

4. It is mandatory that a NO DUE CERTIFICATE is obtained from Finance Department before the final settlement is made.

Could you please tell me if we are eligible for any kind of settlement.

And I don't understand what is this "No Due Certificate". Since I don't keep cash or money. what ever needs to be paid I forward the payment details to Accounts and they deal with it directly. So I don't under what I owe them for a no due certificate.

Thank you for your time.

I think their conditions are reasonable. You should have served notice before resignation.
No Due Certificate is nothing but Clearance certificate to be signed by all depts. It is to ensure that you have handed over all the documents and assets of the institution.

Sorry if this wasn't clear. We did serve our notice, we are still working here! We will only finish our one month by April end only. So that is more than 30 days notice. All my work is in the office computer, and my wife will handover everything as we leave.

Then what is your query? You will get the payment for the month you have worked. You are not eligible for gratuity. Any accumulated PL encashment can be claimed. PF settlement to be done, if applicable.

We don't have any PF. So are you saying it is unreasonable to ask for any kind of compensation?
