Do New Lifting Tools with Manufacturer Certificates Need Third Party Inspection?

I would like to have clarity about TPI (Third Party Inspection) certificates for lifting tools and tackles. There are a few situations I came across, and I actually want to know the correct answer for my concern.

Question on TPI Requirement

My question to everyone here is: Does TPI require for lifting tools and tackles (brought in less than a year) if they come with a manufacturer certificate? I heard that the manufacturer also gets tested by a competent person before providing a manufacturer certificate.

If the tools and tackles come with a manufacturer certificate, then you also have to obtain the competent person certificate for the particular state where the tools are being used. For example, a tool certified by a competent person in Maharashtra holds validity only in that particular state and is not valid for use in any other states.

If the person signing the manufacturer's test certificate is a competent person recognized by the state factory inspectorate, then it is not necessary. Otherwise, you must get a test certificate from a competent person in the prescribed format before the first use. Failure to do so will be non-compliance with the legal requirement.

Please confirm if it is necessary to conduct a TPI (Third Party Inspection) for newly purchased tools and tackles used within the manufacturing state. Please provide the answer with valid proof.

If the tools and tackles are purchased directly from the manufacturer, and after installation, the manufacturer must certify their working condition. However, if you shift the same from one point to another place, then for every shifting, a TPI must invariably be obtained.

As per the Factories Act 1948-Section 29, any lifting machine or lifting tackle used within the factory should be certified for use by a Competent Person. The validity of that certificate is a maximum of one year. If you have bought the said lifting tools or tackles within a year and have the manufacturer's test certificate containing certification by a competent person, then a separate certificate is not required. However, if the manufacturer's certificate was issued over a year ago, then you must get it inspected and certified by a Competent Person before putting it into use.

Yes, TPI is required. That's why the importance of TPI is significant. Whether it is new or old, and whether it comes with a test certificate or not, that does not matter. The conditions in which it is stored at the manufacturing store, and how it is transported—so, before it is taken for first use, it should be tested by a competent TPI person.
