Employer Liability for Medical Expenses: How Should We Handle This Situation?

Dear Seniors,

We are an outsourcing firm. One of our client's factories is located in a non-implemented area as per ESI regulations. ESI has issued a notice stating that we are not required to pay ESI for employees in that location. Consequently, we have ceased deducting ESI amounts from these employees. Our client has obtained a Workmen's Compensation policy specifically for that premises.

Currently, a family member of one of our contract employees is experiencing health issues. The employee is urging us to cover these expenses. To what extent is an employer liable in the aforementioned scenario?

Since there is no ESI coverage, there is no statutory responsibility for providing a medical facility in any form. The Employee Compensation Act has no provision for extending medical facilities to family members.
