Seeking Advice: Should We Declare February 28, 2012, a Paid Holiday for Elections in Noida?

Dear Seniors, I am working in a manufacturing firm based out of Noida. As you all know, on February 28, 2012, elections are happening in Noida.

So, I request you to provide me with your guidance on holiday declaration for the day, i.e., February 28, 2012. Also, if anyone has any kind of government circular that would validate declaring February 28, 2012, as a paid leave/holiday, then kindly share. It's very urgent.

Yes, very much. Even for contract laborers, temporary workers, and casual laborers, it is a paid holiday (even though they may be migrant workers who would have voting rights where your factory is situated). Please find attached a notification to this effect.

I am also working with one of the KPOs in Noida and was looking for the same information on whether to declare February 28, 2012, as an off day. The notice shared by Mr. Sundarararaman is undoubtedly valuable information; however, it is dated April 6, 1999. So, we need to be sure if it still remains the same.

Please note this is valid from this date. Please do not go with the date of the Circular. The content is valid from then on. If we have to go with the date of the Circular, we might as well violate all labor laws, some of which were formed as early as prior to our Independence. What we have to follow is, "IS THERE ANY FURTHER AMENDMENT TO ANY CLAUSE OF THE ACT OR RULES," and accordingly go with the amendments. But the basic Act and Rules remain the same.

To the best of my knowledge, the Circular which I shared is valid and in continuation, and there are no further amendments. You can obtain a copy from your respective Zonal Labor Office because they issue circulars for each and every election.

We are a small company engaged in the outsourcing business. Is it mandatory to keep our office closed on the given day (28th Feb), as many of the big BPOs are open? Do we have to take some special permission from someone to keep our office open? What are our options? Please suggest.

The best way to confirm this would be to call the Election Commission office in Noida and check with them. I am trying to locate their numbers, and if I come across any info, I will let you know.

I am working with a stockbroking company, and the market is open on 28th February. I want to know if it will be a holiday for me or not.

The notices are clear on holidays and no compensation leaves for labor in factories. Can you please confirm if the same applies to general offices as well? I am finding this out for an IT firm based in Noida. Would appreciate a quick response.

If any person stays outside the state of the voting franchising area, how should travel days of one or more days to reach the voting area be treated? Will all travel days plus the election poll day be considered as paid leave, other than company-offered leave, or deducted from company-offered leave (CL/SL/EL)?
