Leave Policy Overview

Dear Friends, please see the attachment for a simple Leave Policy. As you are aware, there is no specific leave policy as per the Acts. However, as HR professionals, we have to frame the leave procedures, which will be useful to all employees in the organization, and get approval from the Management. While seeking approval from the management, we need to explain the benefits to both the employees and the Management.

If the Earned Leaves or Paid Leaves accumulate abnormally, these leaves will be given to the employee upon leaving the service. At that time, his salary may be high, and paying the leave balance amount can be a burden to the Management. Therefore, some leaves will be retained by the Management (e.g., 60 or 30 days). Any excess will be encashed every year in January, ensuring employee satisfaction.

In our company, we have PL and CL in the leave policy and C-Offs. I would like to ask if we can merge C-Offs with other leaves or not. What are the rules for availing CL and PL in a month? Is it compulsory that employees covered under ESIC are not eligible to avail SL?

C-Offs and Leave Merging

C-offs should not be merged with any other leave because the unavailable C-offs at the end of the year can be encashed. However, as per the act, the C-off will be utilized on the next weekly off. The policy will be based on management decisions.

Rules for Availing CL and PL

Please refer to the Leave Policy which I mentioned in the simple leave procedures.

Eligibility for Sick Leave under ESIC

Is it compulsory that employees covered under ESIC are not eligible to avail SL? 'NO,' there is a benefit under the ESIC for availing Sick Leave. However, it is up to the management to provide Sick Leave if it is in the policy.
