Understanding Working Days: Can We Adjust Salary Calculations for Extra Sundays?

Dear Seniors, I would like to ask a favor from you in sharing some of your knowledge with us. As per labor law, there should be 26 working days. In months with 31 days, if there are 4 Sundays, the working days become 27. Can we show 27 days in the Salary/Wages calculation?

Similarly, in a month with 30 days, if there are 5 Sundays, the total working days become 25. Is it acceptable to show 25 days in this scenario?

Yes, you can show the actual number of working days in a particular month. For example, February may have 24 days.

Yes, you can go ahead and reveal the exact number of working days. It doesn't matter whether it is 25, 26, or 27.

Wage Calculation System

The system of 26 days' wages for all months can also be followed for computing wages. In this case, irrespective of the number of physical working days in the month, wages are paid for 26 days, including February. This system is followed when the annual leave credited to an employee is based on a consolidated days basis. Otherwise, the actual working days are followed.

It is okay. Form-12 will show the actual Sunday, whether it is 4 or 5, and the number of working days as 26 or 25.

Calculation of Working Days for Outsourced Employees

I have a logic regarding this issue: 365/12 = 30.46 - 4 (weekly off) = 26 working days. In our company, we are using this formula for calculating the outsourced employees' payment, i.e., 260/26 = 10 * 10000 (rate) = 100000/-.

Understanding Working Days in a Week

The labor laws indicate that the number of working days in a week should be 6 out of 7 days. If we adhere to this, there should be no issue with having 26, 27, or 28 working days in a month.

I'm fully in agreement with Jagadeesh. We are also following this rule. And Avantika, do you have any support for your comment - "Showing more number of working days is wrong." Actually, I want to clarify whether we are wrong or not.

As per labor law regarding working days, it should be 6 in a week excluding Sunday, regardless of the number of days in the month. Please do not overlook the days provided by the government as holidays.

Strictly Observe the Following Holidays:

• Independence Day
• Republic Day
• Gandhi Jayanti
• Labour Day

As per the Minimum Wages Act, if you have to calculate the daily rate as per minimum wages, you have to divide wages by 26 irrespective of the number of days.

Clarification on Working Days as per Factories Act

The Factories Act is very clear on this matter. Please refer to Chapter VI, which covers Working Hours and Weekly Holidays. It does not state that there should be 26 working days. In a nutshell, we need to provide one weekly day off each week.
