Disciplinary Action In LOCAL Language

Dear Friends,
Please advise me, whether all show cause notice, charge sheet, punishment order should be in Local language or is it Ok if we give it in English. Can Employee demand for any orders or chargesheet to be given in Local language only. If yes please let me know under which provision of which Act?

Dear Pashya,

Yes. it is advisable to issue a showcause, chargesheet or punishment order in the local language....

You can go throught the Industrial Disputes Act to get more information on it....

The disciplinary action has been provided in Industrial Employment Standing Orders Act, wherein it provides that the showcausenotice/charge sheet or any communication to the worker should be in local langauge. But you can issue these in English. However, if worker asks for translated version of the English order, you must provide for the same.Further, in case, you have to provide for such translation, you can make in free local language with a note at the end that" The above is free (the local language )translation of the original letter dated............ in English and for any technical meaning the English version shall be held valid".
In case of clerical staff and other staff you can issue the same in english only.
