Struggling to Get My Experience Letter After Layoff: How Can I Secure It Legally?

I have been terminated before 6 months along with a few of my colleagues. The company has said that they don't have work in our technology, that's why they are closing this department. Now, somehow I managed to join another company, meanwhile, I am trying to get an experience letter and the remaining salary for the last 2 months from the previous company. I always call HR, and she said that the CEO is in the USA and when he will come back, you can talk with him.

Now I need an experience letter for 2 years and 6 months, which I had spent working with the organization. Please suggest a proper way to get my experience certificate so that at least I will get my next job. Is there a legal notice to be sent to the company by all of us employees who were fired at that time? Please suggest the right way to get my experience letter.

First, please see this forum itself—there are many postings related to your problem. Next, talk to your new company explaining the problem. Also, check if your pay slips along with your appointment letter or most recent review letter will solve your issue (as some companies accept a combination of these documents).

Instead of discussing over the phone, consider visiting your old company personally to verify if the information the HR person provided regarding the CEO being in the USA is accurate. Sometimes, face-to-face meetings can resolve matters effectively.

Typically, companies that terminate employees provide all necessary documents at that time. You didn't mention what occurred when you were fired.

Please submit your previous company's appointment letter and latest pay slip to prove your length of service. Always tell the truth; explain to them that you and some of your other colleagues have been terminated due to redundancy in your stream, for which they have not issued any letter to that effect.

Explain to your previous employer about the employee referral whose name you have provided. In case of any calls from the new company, please remember us and explain the correct scenario under which circumstances you were removed. That should resolve your problem. Why do you want to turn a small issue into a big complication?
