Left Job Without Notice: Is It Normal for My PF to Cover Full and Final Settlement?

I was working with Standard Chartered Bank. My bank account was with the same bank. When I left the company, I did not serve the 3-month notice period. When the PF was calculated and deposited into my SCB account, they utilized the whole amount towards adjusting my entire full and final settlement. Is this the norm?

Dear Aparajita,

No one can access your PF money whether you served the notice period or not; that is immaterial. All deductions made during your tenure would have been deposited with the PF authorities. When you resign from the company, you can apply for Form 19 & 10C to withdraw your PF amount with interest. Alternatively, you can transfer the amount to your existing company.

This is not the norm. They should have gotten permission from you before using your PF money for settlement of your not serving notice period. You can go to the authorities or labor court to take penal actions against them. But your not serving the notice period was not a good thing anyway.

As per the law, the employer has no right to hold your PF payment against your Full & Final Settlement and also can't stop your PF legally. Could you please briefly explain the situation you were facing so that I can help you accordingly?
