13th May 2008 From United Arab Emirates, Dubai
It's a very good idea...
laws keep changing here and sometines we are unaware of the latest changes..
anyways let me start with this query..
1) If a company does not give an employee NOC, and if he gets a ban from labor of 6 months, is there any other way he can lift the ban ? I'm talking baout an employee who has finished 1 year of service only...
Thanks in advance...
Sandeep
13th May 2008 From United Arab Emirates, Dubai
Yes Mr Sandeep,
6 months ban can be lifted by paying AED5000/ as he has completed one year of service.
This payment can be made by the employee himself or the new employer.
It is applicable for all category.
If an employer imposed ban more than actual six months, it is very difficult to lift. Then the employee move to labour and act on the situation

I've a Q'n...
What if a person is terminated during probation??? Will he get a ban if his sponsor does not give him an NOC?
14th May 2008 From United Arab Emirates, Dubai
Hi all,
I am hari , working as a BDM in bangalore. I was working in dubai , due to ma father's health condition I was forced to come back to india. I did not cancel ma employment visa in dubai. Now i have planned to go for higher studies , I wanted to know that whether will it be an issues since I have not cancelled the visa. Will it affect my career if I am planning to go to some other countries?? When I asked my company , they told me that if i am not returning back in 6 months the visa will get automatically cancelled.
Regards,
Hari
14th May 2008 From India
hi mildred,
if a person is terminated during probabtion he/she will have to reimburse all the costs to the company any expenses incurred in getting him/her on board.
there could be a chance in him getting a ban if the sponsor does not give him an NOC.
He has to amicably request them to give him an NOC or pay them any compensation. In this was an NOC could be given....
14th May 2008 From United Arab Emirates, Dubai
hi hari, you can travel to any other country, there is no problem. but if you want to come back here, you will have to get it cancelled here to apply for a re-entry... regards, sandeep
14th May 2008 From United Arab Emirates, Dubai
What if a person completes his 3 yr contract.... will he still have the 6 months automatic labour ban???
I had a problem with one candidate on the visa issue... he had completed 2.9 months in his previous company (after his visa was stamped) but it has crossed 3yrs from his DOJ coz he worked on visit. N now we canít get an employment visa coz the system shows he has 6 months ban... We are not allowed to lift it also...
The visa issue here is making recruitment even tough added to the scarce man power supply in this region...
14th May 2008 From United Arab Emirates, Dubai
Hi,
Thanks for the mail, but according to the labour law currently , the visa gets automatically cancelled and the passport number will be sent to the absconding list in the UAE embassy, moreover we cannot enter UAE for the entire life... is that true?
14th May 2008 From India
Dear friend.
if you have work permit visa in UAE, Exist the country more then 6 months then your visa going to cancell automtical and your passport detils going to immmgartion for life time ban!
Regards
Raghav

Well hi all

Have spent sometime in dubai as a matter of fact the past 6 1/2 years. Could maybe contribute to the discussion

A) dubai is currently following an outdated labour law but which is now under revision and is available for all to see in the UAE ministry site

B) as far as bans go all cancelled visas immediately and automatically get a 6 months ban unless NOC is provided by employer.

C) Further incase 6 month ban is there then visit visa is usually taken for the candidate and then renewed after 3 month.Trips to Kish for junior management and to India or as applicable is usually done for the visa change

d) in the event that an employer files an absconding report at labour then this at least in dubai requires proper justification and proof.sometimes people are on vacation or company sends for projects out of UAE project bombs absconding report is filed!!! so then an absconding report is filed person id banned from entry into UAE please note this(all 7 emirates for life) before computerization people used to enter through other emirates. So no chance of a visit also

e)If one year ban is put then also at least in dubai the company has to be very powerful and have excellent contacts. If not the labour does no accept.Becaus in the event of 1 year ban also person cannot enter UAE on visit. It gos to immigration dept. also so no entry.

F) with reference to an article in Gulf news 4 months back approximately there is no comprehensive mention of bans in the labour laws.It seems that labour department themselves are confused about this.

G) Lastly labour laws are different from free zones. There there is no bans. You can change companies provided contract is fulfilled

H) In the event that probation is on then also companies that sponsor the visa have a right to ban the employee which is what many of the companies do.

I) Lastly to combat such practises Mission visa is now instituted in dubai labour.where a person is given visa for four months and his depending on the contract between company and individual even family can be brought to uae. This is good for it and short term projects or also for top positions in probation.

Now after having said all this i also have to inform you that there are companies which are owned by the government that are not even registered with the labour dept.YES this is true.they do not have any of there employee contracts registered with labour dept because they are government or as i call it semi public since govt companies now seem to have IPO's that are grand!! You would not believe this but these companies can do what they want.they deal directly with the immigration and an employee who has been wronged cannot go to labor because the labour says they are not registered with us and they do not come within our jurisdiction!!!

Lastly there is also premptive visa for govt. semi govt companies. In the event that they need you they will ask you if the current company is going to ban you when you leave. In the event that you say yes they will give something called a preemptive application!!! You wouldn't believe but with this application when the current company cancels visa and tries to put any ban they will be told that the moment visa is cancelled the person has been transfered to another visa:) hence the preemptive application.but this is only possible for govt. semi govt.

At the very end as long as the company is not semi government or any such extremely powerful company there are sources through which even the 1 year ban can be removed:) unfortunately i cannot state these sources but they are available in dubai.Basically the record of your ban will be erased and you can apply for a visa again :)

As for the 6 month ban the option is is visit visa or in case of big companies they give a letter to labour and get ban removed.

Well hope all that was useful. Will do my best to give more information where possible

there would be no problem for you as your employer would cancel your visa them self as it is compulsory as per uae law to cancel the visa, one more reason to cancel your visa is that they would get back the visa deposit amount from the labour office.

Hi
I joined today.

I was working in Dubai for 3years. i planed to open a company in dubai, and searhing for PRO, finally i approached one PRO,unfortunately he was my company's PRO. I drop the idea of joining that PRO for my business.Things were going fine. I decided to resign my company and got one new and best offer in my hand. I was happy. One fine day, i met PRO with my Boss, then my boss came to know about my idea of opening a company, through that PRO. The problem started.... HE didnt give me NOC, and lodge a absconding complaint against me. I fight in labour court, decesion was in my side(i felt that time). i got banned for one year. After 1.5 year i got good offer in dubai, i got employment visa also. when i landed dubai air port,i came to know that i got life time imigrationban.

My question is
1. Why i got visa ,while lifetime immigration ban was there .
2. Is possible to waive (lift) lifetime immigration ban? if YES , HOW?
3. Is immigration is baned for all 7 emirates?
4. why i got lifetime imigration ban, once i proved that iam not absconding ,in labour court.
5. why they didnt tell me that immigration is lifetime banned? why labour court cheated labour?

Please anyone can help me?

18th October 2008 From United Arab Emirates, Dubai
Hi

Recently two guys been recruited & I was trying to lift labour ban for them, I could know that if you finish 3 years of contract,
you can lift the ban by the new employer, if you have ban by cancelling the visa before 3 years then you need a NOC from the company which you where working. Then only your new employer can lift the ban. But make sure that if you renew the contract for next 3 years then you need to finish that contract.

But this ban wont effect you if you join in a free zone company.

If you have any new updation on this, do let me know.

Regards

Rajesh

24th November 2008 From United States, Cambridge
Termination of contract during or at the end of probation can be done without notice and in such case none of the party( one which cancelled the contarct) is liable to pay any reimbursements / fines .
but if the contract is limited 9max 4 years)and the employee breaks the contract before its completion then he is subject to one year ban +
compensation payable equal to one and a half months salary for three months or the remaining period of contract whichever is less and non payment of end of service benifits .
but if the contract is unlimited then with one month notice you can leave the service but an automatic labour ban of six months shall be applied but if completed one year service then you are eligible for grtauity payable which shall be 21 days for each completed year .but no need to pay any compensation.
i would like to hear from members who are working in uae as I m myself working in ajman in hR dept.so that we may get in touch personally too
